These Terms of Use ("Terms") govern your access to and use of the Smart Note mobile application ("Smart Note", "the app", "we", "our", or "us"), developed by GoodLuck3301. By downloading, installing, or using Smart Note, you agree to these Terms. If you do not agree, do not use the app.
1. Description of Service
Smart Note is a productivity application for Android that provides tools for managing notes, tasks, diary entries, bookmarks, and calendar events, along with optional AI-assisted features, home screen widgets, reminders, and data import/export. Smart Note is provided free of charge unless otherwise stated.
2. Eligibility
You must be able to form a binding contract under applicable law to use Smart Note. If you are under the age of majority in your jurisdiction, you may use the app only with the consent and supervision of a parent or legal guardian.
3. Your Content and Data
You retain ownership of all content you create or store in Smart Note, including notes, tasks, diary entries, bookmarks, and other personal data. Smart Note stores this content locally on your device. You are solely responsible for the content you create, import, export, or share through the app.
You agree not to use Smart Note to:
- Store or transmit unlawful, harmful, abusive, or infringing content
- Violate any applicable law or regulation
- Attempt to reverse engineer, decompile, or exploit the app in unauthorized ways
- Interfere with the app's operation or security
4. Optional Third-Party Services
Smart Note may integrate with third-party services that you choose to enable, including AI providers such as OpenAI and Google Gemini. When you configure these integrations:
- You provide your own API credentials and are responsible for compliance with those providers' terms and billing
- Data you send through AI features is transmitted directly to the third-party provider you select
- We are not responsible for the availability, accuracy, or policies of third-party services
Your use of third-party services is subject to their respective terms and privacy policies in addition to these Terms.
5. Device Permissions and Features
Certain features require Android permissions (such as calendar access, notifications, or internet access). You may grant or revoke these permissions through your device settings. We are not liable for reduced functionality resulting from denied permissions.
Optional features such as app lock (biometric or device credential authentication) and screenshot blocking rely on your device's operating system. We do not guarantee that these features will prevent all unauthorized access.
6. Import, Export, and Backups
Smart Note offers manual import and export functionality. You are responsible for safeguarding exported files and any passwords used for encryption. We are not responsible for data loss caused by device failure, accidental deletion, failed imports/exports, or user error. You should maintain your own backups of important data.
7. Intellectual Property
Smart Note, including its design, code, branding, and documentation (excluding your user content), is owned by GoodLuck3301 and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks or branding except as necessary to use the app as intended.
The app may include open-source software components subject to their respective licenses. Nothing in these Terms limits your rights under those licenses.
8. Disclaimer of Warranties
Smart Note is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The app will be uninterrupted, error-free, or secure
- AI-generated responses will be accurate, complete, or suitable for any purpose
- Reminders, widgets, or calendar features will always function correctly on all devices
- Defects will be corrected within any particular timeframe
9. Limitation of Liability
To the maximum extent permitted by applicable law, GoodLuck3301 and its contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of Smart Note, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from these Terms or your use of the app shall not exceed the amount you paid for Smart Note in the twelve (12) months preceding the claim, or zero if the app was provided at no charge.
10. Indemnification
You agree to indemnify and hold harmless GoodLuck3301 from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of Smart Note, your content, your violation of these Terms, or your use of third-party integrations configured through the app.
11. Changes to the App and Terms
We may update Smart Note or these Terms at any time. Material changes to these Terms will be reflected by updating the "Last updated" date above. Your continued use of Smart Note after changes take effect constitutes acceptance of the revised Terms. If you do not agree to updated Terms, you must stop using the app and may uninstall it.
12. Termination
You may stop using Smart Note at any time by uninstalling the app from your device. We may discontinue or modify the app at any time without liability. Upon termination, sections of these Terms that by their nature should survive (including disclaimers, limitations of liability, and indemnification) will remain in effect.
13. Governing Law
These Terms are governed by applicable laws in the jurisdiction of the developer, without regard to conflict-of-law principles. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force.
